ASSUMPTION OF RISK WAIVER AND RELEASE OF LIABILITY AND INDEMNITY

 

In consideration of being allowed to participate in the GPC Athlete Apex online fitness program (the "Program") provided by GPC Performance, I, [Subscriber- You], hereby acknowledge and agree to the following terms and conditions:

 

Assumption of Risk: I understand and acknowledge that participating in the Program involves physical activity, which carries inherent risks, including but not limited to the risk of bodily injury, illness, or death. I voluntarily assume all such risks associated with my participation in the Program.

Release of Liability: I hereby release, waive, discharge, and covenant not to sue GPC Performance, its owners, employees, agents, instructors, and affiliates (collectively referred to as the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including but not limited to bodily injury, illness, or death, sustained by me during or as a result of my participation in the Program, including any injuries resulting from exercises, routines, or recommendations provided by GPC Performance or its instructors.

Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liabilities, damages, losses, costs, expenses, including reasonable attorney's fees, arising out of or related to my participation in the Program or any breach of this agreement by me.

Medical Clearance: I certify that I am physically fit and have no medical condition that would prevent my participation in the Program. I understand that it is my responsibility to consult with a physician before beginning any exercise program.

Use of Likeness: I grant GPC Performance the irrevocable right and permission to use my name, likeness and any photographs or recordings of me taken during the Program for promotional and marketing purposes, without compensation to me.

Binding Effect: This agreement shall be binding upon me and my heirs, successors, assigns, and legal representatives.

Governing Law: This agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without giving effect to any choice of law or conflict of law provisions.

I have read this assumption of risk waiver and release of liability and indemnity agreement, fully understand its terms, and voluntarily agree to be bound by it.

Cancellation Policy for GPC Athlete Apex Program

Subscription Basis: The GPC Athlete Apex program operates on a weekly subscription basis. By subscribing to the program, you agree to abide by the cancellation policy outlined herein.
Cancellation with 7-Day Notice: Clients are free to cancel their subscription to the GPC Athlete Apex program at any time. However, to ensure smooth processing of cancellations, clients must provide a minimum of 7 days' notice prior to their next scheduled payment date.
Notice of Cancellation: Clients wishing to cancel their subscription must notify GPC Performance by emailing gpcper4mance@gmail.com. The cancellation notice must include the client's full name, email used during registration, and the desired date of cancellation.
Effective Date of Cancellation: Cancellations will be effective as of the end of the current subscription period following the receipt of the 7-day notice. Clients will continue to have access to the program and its benefits until the end of the current paid period.
No Refunds for Partial Periods: GPC Performance does not provide refunds or credits for partial subscription periods, including but not limited to unused days within the final week of the subscription.
Automatic Renewal: Unless cancelled in accordance with this policy, subscriptions to the GPC Athlete Apex program will automatically renew on a weekly basis, and the applicable subscription fee will be charged to the client's chosen payment method.
Modification of Policy: GPC Performance reserves the right to modify or update this cancellation policy at any time. Clients will be notified of any changes via email or through the program's website.
By subscribing to the GPC Athlete Apex program, you acknowledge that you have read, understood, and agree to abide by the terms of this cancellation policy.
